Terms & Conditions
These Terms govern your access to and use of SimCalio (the "Service"), operated by LupusDL Co. ("we", "us", "our"). By accessing or using the Service, you agree to these Terms.

1) Acceptance
By using SimCalio, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
2) Eligibility
You must be legally able to enter into a contract in your jurisdiction to use the Service. If you are under the age of majority, you may only use the Service with consent and supervision from a parent or legal guardian.
3) The Service
SimCalio is a nutrition and fitness tracking platform that may include features such as meal logging (manual and chat-based), micronutrient and macronutrient summaries, hydration tracking, workout logging, and recommendations. Some features may be experimental or released in phases (e.g. OCR workout import beta; rule-based recommendations at launch; ML-based features later).
Feature availability may depend on your plan (free vs premium), geography, device, or technical constraints.
4) Health & Medical Disclaimer
Not medical advice
SimCalio provides informational outputs and general guidance only. It is not a medical device and does not provide medical advice, diagnosis, treatment, or prescriptions. Nothing in the Service should be used as a substitute for professional medical advice.
You agree that:
- You are solely responsible for your diet, training, and health decisions.
- You will consult a qualified professional before making significant changes, especially if you have a condition, injury, pregnancy, or dietary restrictions.
- You will not rely on the Service for emergencies. If you believe you have a medical emergency, contact local emergency services immediately.
5) Accounts & Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information during signup and keep your account information up to date.
We may suspend or terminate accounts that appear to be compromised, used fraudulently, or used in violation of these Terms.
6) Subscriptions, Trials & Billing
Some features require a paid subscription. Plans may include a free trial period. If you start a paid plan, you authorize us (and our payment processor) to charge your selected payment method on a recurring basis until you cancel.
- Payments: Payments are processed by third parties (e.g. Stripe). We do not store full payment card details.
- Cancellations: You can cancel at any time. Access may continue until the end of the current billing period, unless required otherwise by law or store policy.
- Refunds: Unless required by applicable law, fees are non-refundable once charged.
- Discount codes: Discount codes may be single-use and tied to an account; misuse may invalidate a code.
7) Privacy, GDPR & Health Data
You enter "health-related" data — we treat it carefully
The Service may process data about your nutrition, body measurements, and fitness routines. Under EU law this can be "special category" personal data if it reveals health information. We require explicit consent where legally required.
Our processing of personal data is described in our Privacy Policy. In summary:
7.1 Data you may provide
- Account data (e.g. username, email for recovery).
- Nutrition logs (foods, quantities, meals, saved history).
- Hydration logs (tracked separately from calories).
- Fitness logs (workouts; screenshots if you use OCR import).
- Optional body metrics (weight and measurements).
7.2 Legal basis and consent
We process personal data to provide the Service (contract performance), to secure the Service (legitimate interests), and to comply with law. Where special category data is processed, we rely on your explicit consent or another valid legal basis.
7.3 Your GDPR rights
Subject to conditions and exceptions under GDPR, you may have the right to access, rectify, delete, restrict processing, object, and data portability. You may withdraw consent at any time (where processing is based on consent).
7.4 Deletion and retention
The Service is designed to support user-controlled deletion (account and associated data) via Settings or by contacting us. We may retain limited records where required for legal compliance (e.g. billing, fraud prevention) and only for as long as necessary.
7.5 Security
We implement technical and organizational measures appropriate to the risk (e.g. access controls, encryption at rest/in transit where supported, and role-based access control). However, no system is perfectly secure, and you accept that residual risk exists.
7.6 Processors and third parties
We use service providers ("processors") to operate SimCalio. These may include:
- Hosting/auth/database: Firebase Authentication and Firestore (Google).
- Payments: Stripe (PCI-compliant processor).
- AI processing: AI providers used to parse entries (e.g. meal parsing, photo understanding) and generate outputs.
Where processors are outside your country, cross-border transfers are handled using appropriate safeguards as required by GDPR.
8) AI Features & Outputs
Some Service features may use AI to interpret your inputs (including text or images) and produce outputs such as nutrition estimates, categorization, or suggestions. AI can be incorrect, incomplete, or inappropriate for your specific context.
- You agree to verify outputs before acting on them.
- You agree not to use AI outputs as medical advice.
- We may add guardrails (e.g. avoiding diagnostic language) but cannot guarantee correctness.
9) Acceptable Use
You agree not to:
- Use the Service for unlawful purposes.
- Attempt to gain unauthorized access to systems or other users' data.
- Upload content that is malicious, abusive, or infringes rights of others.
- Reverse engineer, scrape, or abuse the Service (except where allowed by mandatory law).
- Use the Service to provide professional health services to third parties without appropriate authorization.
10) Intellectual Property
SimCalio and its underlying software, designs, and branding are owned by LupusDL Co. or its licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial use unless we agree otherwise in writing.
11) Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or that outputs will be accurate or complete.
12) Limitation of Liability
To the maximum extent permitted by applicable law, LupusDL Co. will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses arising from your use of (or inability to use) the Service.
To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid to us for the Service in the 12 months preceding the event giving rise to the claim (or €50 if you paid nothing).
13) Indemnity
You agree to indemnify and hold harmless LupusDL Co. from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service, violation of these Terms, or infringement of any rights of another.
14) Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if required for safety, security, or legal compliance.
15) Governing Law (Cyprus) & Disputes
These Terms are governed by the laws of the Republic of Cyprus, without regard to conflict of law principles. Courts in Cyprus will have jurisdiction over disputes, subject to any mandatory consumer protection rules that apply in the EU.
16) Changes to these Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you (for example, via the Service). Continued use after the effective date means you accept the updated Terms.
